By creating an account or using VitaPulse (https://vitapulse.e-xode.net), operated by e-xode, you agree to these Terms of Service. If you do not agree, please do not use the service. These terms apply to all users, whether on a free or paid plan.
2. Description of the Service
VitaPulse is a web performance monitoring platform powered by Google Lighthouse. The service allows you to run performance, accessibility, best practices, and SEO audits on your websites, track Core Web Vitals over time, detect regressions, generate PDF reports, and collaborate with team members. VitaPulse is provided as a Software-as-a-Service (SaaS) accessible via a web browser.
3. User Accounts
You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You must notify us immediately of any unauthorized use. VitaPulse reserves the right to suspend or terminate accounts that violate these terms or are used for abusive purposes.
4. Plans and Billing
VitaPulse offers Free, Pro, and Business plans with different feature sets and usage limits. Paid plans are billed monthly or annually through Stripe. You may upgrade, downgrade, or cancel your subscription at any time. Downgrades take effect at the end of the current billing period. Refunds are handled on a case-by-case basis — contact us if you have concerns.
5. Acceptable Use
You agree to use VitaPulse only for lawful purposes. You may not: use the service to scan websites you do not own or have permission to test; attempt to circumvent rate limits, quotas, or access controls; interfere with the service's infrastructure or other users' experience; resell access to the service without authorization; use automated tools to scrape or extract data from VitaPulse beyond the intended API.
6. Intellectual Property
VitaPulse, its design, code, and branding are the property of e-xode. Scan results and audit data generated for your websites belong to you. You may download, share, and use your reports freely. The Lighthouse audit engine is an open-source project by Google — VitaPulse does not claim ownership of the audit algorithms themselves.
7. Data and Privacy
We collect and process personal data in accordance with our Privacy Policy. You retain ownership of all data you provide and all scan results generated. Upon account deletion, your personal data and project data are permanently removed within 30 days. We do not sell, rent, or share your data with third parties for marketing purposes.
8. Disclaimer of Warranties
VitaPulse is provided "as is" without warranty of any kind. While we strive for accuracy, Lighthouse audit results depend on many factors (network conditions, server response time, page content) and may vary between scans. VitaPulse does not guarantee specific performance improvements based on audit recommendations.
9. Limitation of Liability
To the maximum extent permitted by law, e-xode shall not be liable for any indirect, incidental, or consequential damages arising from your use of VitaPulse. Our total liability for any claim related to the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.
10. Changes to Terms
We may update these Terms of Service from time to time. Significant changes will be communicated via email or an in-app notification. Continued use of the service after changes constitutes acceptance of the updated terms.
11. Governing Law
These Terms of Service are governed by French law. Any disputes arising from the use of VitaPulse shall be submitted to the exclusive jurisdiction of the competent courts in France.
